DCMA – Copyright policy
Digital Millennium Copyright Act
Welcome to our website. We respect the intellectual property rights of others and expect others to respect our rights as well. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), a copyright owner or their authorized agent may submit a takedown notice to us via our designated DMCA Agent. As an internet service provider, we may claim “safe harbor” protections under the DMCA for copyright infringement claims.
Submitting a Copyright Infringement Notice
To submit a valid DMCA takedown notice, please include the following information:
A physical or electronic signature of the copyright owner or an authorized agent.
Identification of the copyrighted work that is claimed to have been infringed.
Identification of the infringing material to be removed, including information sufficient to locate it, such as the URL.
Contact information of the complaining party, including your name, address, email, and phone number.
A statement confirming your good faith belief that the use of the material is unauthorized.
A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Please send all takedown notices through our Contact page. Email is recommended for prompt attention. Note that we may share the identity and information of any copyright infringement claim with the alleged infringer. By submitting a claim, you agree that your information may be communicated to the alleged infringer.
Counter Notifications – Restoration of Material
If your material has been removed due to a copyright claim, you may submit a counter notification to request restoration. Your counter notice must include:
Your physical or electronic signature.
A description of the removed material and its original location.
A statement under penalty of perjury that you believe the removal was due to mistake or misidentification.
Your name, address, and phone number, along with consent to the jurisdiction of the federal district court where your address is located (or any judicial district if outside the United States), and agreement to accept service of process from the original complaining party.
Send your counter notification through our Contact page, preferably via email.
Repeat Infringer Policy
We take copyright infringement seriously. We maintain a record of DMCA notices and make good faith efforts to identify repeat infringers. Accounts of users who repeatedly violate our copyright policy may be terminated.
Intellectual Property and Publicity Rights
We value our community and work with freelance designers worldwide. While we carefully review submitted designs, some may misrepresent their ownership. If you find artwork on our site that belongs to you, we will remove it within 24 hours and provide appropriate credit.
Copyright Law protects the expression of original ideas in tangible forms, such as artwork, photographs, and literary works.
Trademark Law protects words, symbols, designs, or logos that identify and distinguish goods.
Publicity Rights protect an individual’s name, image, and likeness, meaning you cannot use someone else’s identity for commercial purposes without consent.
If you believe your rights have been infringed, please submit a Notice and Takedown Report including:
A link to the infringing item.
Proof of your artwork or original work.
Your name and contact information.
Use the email subject: TAKEDOWN REPORT.
